1. Overview

This policy explains how Curated Temper handles copyright-related notices — both as a service preparing notices on behalf of rights holders, and as a website operator that may receive notices regarding content on curatedtemper.com.

2. Notices Prepared on Your Behalf

Our Role as Authorized Agent

When you subscribe to our Shield or Temper plans, you authorize Curated Temper to act as your authorized agent for preparing and submitting DMCA Section 512 takedown requests. This authorization is limited to specific submissions you individually review and approve.

Elements of a Valid DMCA Notice

Under 17 U.S.C. § 512(c)(3), a valid notice must include:

Your Responsibility

You remain responsible for the accuracy of every notice submitted on your behalf. Submitting information you know to be false may expose you to liability under applicable law. We reserve the right to decline any submission that appears inaccurate, incomplete, or made in bad faith.

3. Counter-Notices

What is a Counter-Notice?

A party whose content was removed may file a counter-notice under 17 U.S.C. § 512(g). Platforms generally restore removed content within 10–14 business days of a valid counter-notice unless the rights holder initiates legal proceedings.

How We Handle Counter-Notices

If a counter-notice is filed in response to a submission we made on your behalf, we will notify you promptly and provide guidance on the response process. We can assist in connecting you with independent legal counsel where escalation is required.

4. Reporting Infringement on Our Website

If you believe content on curatedtemper.com infringes your copyright, please send a notice containing all elements listed in Section 2 to our designated DMCA agent. Please include "DMCA Notice" in the subject line.

5. Counter-Notices Regarding Our Content

If you believe content was removed from our website in error, submit a counter-notice to the same address complying with 17 U.S.C. § 512(g)(3).

6. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), we maintain a policy of terminating accounts of users who are repeat infringers of intellectual property rights.

7. EU Article 17 Submissions

For EU-based creators, we prepare submissions aligned with Article 17 of the EU Copyright Directive and applicable national legislation. The same review and approval workflow applies. You remain responsible for the accuracy of all EU-related submissions.

8. Force Majeure

We are not responsible for delays in submission processing caused by platform outages, platform policy changes, third-party service failures, or other events outside our reasonable control.
