1. Introduction & Acceptance

These Terms of Service govern your access to and use of services provided by Curated Temper. By using our services you agree to be bound by these Terms. If you do not agree, do not use our services.

Curated Temper is not a law firm and does not provide legal advice, legal representation, or legal counsel. Nothing we provide constitutes legal advice or creates an attorney-client relationship.

No Guarantee of Outcome

We do not guarantee that any submission will result in content removal, a platform response, or any particular outcome.

Enforcement Support Only

We are an IP monitoring and enforcement support service. We identify potential unauthorized uses of your work, prepare documentation for your review, and submit on your behalf only upon your explicit approval.

3. Eligibility

• You must be at least 18 years of age.
• You must have legal capacity to enter binding agreements.
• You must be the owner or authorized representative of submitted works.

4. What We Do

• Ongoing AI-assisted monitoring of supported platforms and public web sources.
• Review of flagged matches through automated systems and human review workflows.
• Preparation of DMCA takedown request documentation for your review and approval.
• Preparation of cease and desist letter drafts for your review.
• EU Article 17-style submission support for European platforms.
• Monthly reports summarizing monitoring activity and case status.

5. Your Responsibilities

By submitting any creative work you warrant that you are the original creator or authorized rights holder and all information you provide is accurate. You remain responsible for the accuracy of all submissions you approve.

We reserve the right to decline any request that appears incomplete, inaccurate, abusive, or inconsistent with applicable law or platform policy.

6. Subscription & Payment

Plans: Watch ($29/mo), Shield ($69/mo), Temper ($129/mo). Billed via Stripe. Cancel anytime — cancellation takes effect at end of current billing period. All sales are final except where required by law.

7. No Warranty

Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability.

8. Limitation of Liability

• We are not liable for indirect, incidental, or consequential damages.
• Our total liability shall not exceed fees paid in the three months preceding a claim.
• We are not liable for platform decisions or outcomes of submissions.

9. Force Majeure

We are not responsible for delays or failures caused by platform outages, third-party service failures, API restrictions, cyber incidents, governmental actions, or other events outside our reasonable control.

10. Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the services at any time, with or without notice.

11. Governing Law

These Terms are governed by the laws of the United States and applicable state law.
